A BILL to amend and reenact section twelve, article twelve, chapter sixty-two of the code of West Virginia, one thousand nine hundred thirty-one, as amended, relating to the board of parole, membership and salaries.

Be it enacted by the Legislature of West Virginia:

That section twelve, article twelve, chapter sixty-two of the of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended and reenacted to read as follows:
ARTICLE 12. PROBATION AND PAROLE.
§ 62 - 12 - 12. Board of parole generally.

There shall be a state board of probation and parole, known as the "West Virginia Board of Probation and Parole." The board shall consist of five three members, not more than three two of whom shall at any one time belong to the same political party. The board shall be appointed by the governor by and with the advice and consent of the Senate. Each member of the board shall have had experience in the fields of social science or administration of penal institutions and shall be familiar with the principles, practices and problems thereof and shall be otherwise competent to perform the duties of his office. The members shall be appointed for overlapping terms of six years, except that the original three appointments shall be for terms of two, four and six years, respectively, such appointments to be made beginning on the first day of July, one thousand nine hundred fifty-three. The additional two appointments made pursuant to the amendments made to this section during the regular session of the Legislature in the year one thousand nine hundred ninety-four, shall be for six years each, with such terms to commence on the first day of July, one thousand nine hundred ninety-four. Any member shall be eligible for reappointment. Notwithstanding the provisions of section two-a, article seven of chapter six of this code, the members shall receive an annual salary of forty thousand to be fixed by the governor, not to exceed seventy-two hundred dollars and necessary expenses incurred in the discharge of their official duties. The members of the board shall devote their full time and attention to their duties as members thereof.




NOTE: The purpose of this bill is to increase the size of the Board of Parole from three to five members and to increase members' salaries to $40,000.
